EU4PFM and Antimonopoly Committee expand agenda on procurement and PPPs

Experts from the EU4PFM Procurement Component and the EU Delegation to Ukraine met with representatives of the Antimonopoly Committee of Ukraine (AMCU) to advance discussions on the ongoing cooperation agenda in the field of public procurement, including the draft Public Procurement Law, public-private partnerships (PPPs) and concessions as well as the capacity building. The meeting focused on progress achieved under Chapter 5 “Public Procurement” of Ukraine’s EU accession process, and outlined future co-operation priorities.

AMCU representatives noted that, when reviewing complaints, the Committee identified gaps in the legislation. They shared their vision for improving procurement review procedures and presented proposals regarding the actions of both contracting authorities and economic operators.

Eriks Mezalis, Team Leader of the EU4PFM Procurement Component, reiterated the Project’s support for extending complaint possibilities to the Prozorro catalogue, as well as electronic tools such as dynamic purchasing systems and framework agreements. Both sides also agreed on the importance of clarifying the definition of eligible complainants.

The discussion further addressed review and complaints in the context of PPPs and concession contracts. EU4PFM experts stressed the importance of a reliable review system for PPPs, given the AMCU’s strong reputation in this area, and offered continued support for strengthening the Committee’s role as the review body for such transactions.

Looking ahead, the partners outlined opportunities for capacity building during the next phase of the Project. These include experience exchange visits and enhanced cooperation with review bodies from the EU Member States.

The meeting concluded with a shared commitment to further cooperation, aimed at strengthening Ukraine’s public procurement system and broadening the AMCU’s review capabilities.
