EU4PFM Procurement Expert Highlights from the «Prozorro Market: Efficiency and EU Alignment» Forum
Reflecting on November’s procurement developments, we highlight the month’s key event: «Prozorro Market: Efficiency and EU Alignment» supported by the EU4PFM Public Procurement Component.
Below are the main takeaways shared by EU4PFM Procurement Experts — Team Leader Eriks Mezalis and Senior Legal Expert Oleksandr Shatkovskyi — during the panel discussion:
- Each new tool is implemented to simplify and solve the daily operational challenges of procurement specialists. Many of these solutions originate in the EU. Dynamic purchasing systems, e-contracting, e-marketplace related decisions being subject to review are a standard practice across EU Member States.
- Ukraine must integrate these tools into its legal and technical environment. This is essential both to align with the upcoming Public Procurement Law and to improve workflows for contracting authorities, businesses and public institutions.
- The draft law on public procurement is based on the EU Directives, which reflects Ukraine’s EU candidate status. It is expected that it will introduce further adjustments to bring Ukraine’s procurement legislation even closer to the EU legal framework.
- The first area requiring such an adjustment is the EU-compliant procedure for entering goods into an electronic marketplace. EU Directives allow contracting authorities to use different procedures and tools in combination. The dynamic purchasing system is one such tool. It works as a restricted procedure and is widely used as an effective practice across the EU.
- The second area is the approach for determining the estimated value of procurement. The third area concerns centralised procurement. Under EU rules, all decisions by a contracting authority or contracting entity must be subject to potential appeal to the national review body. In Ukraine this oversight role belongs to the Antimonopoly Committee.
The EU4PFM Public Procurement Component will continue cooperating with partner institutions to support the alignment with the EU acquis.
