Judicial review of public procurement disputes: EU4PFM and the National School of Judges held two-day training in Dnipro
On 15–16 September, EU4PFM Procurement Component, in cooperation with the National School of Judges of Ukraine, held a two-day training for judges “Modern Approaches to Resolving Public Procurement Disputes: European Integration and Digital Transformation.” The speakers included judges of the Supreme Court and regional commercial courts, EU4PFM experts, as well as representatives of the Antimonopoly Committee of Ukraine and the State Audit Service of Ukraine.
The training aimed to deepen judges’ understanding of the legal framework governing public procurement in the context of Ukraine’s European integration, examine recent changes to national legislation and strengthen their ability to use digital tools in judicial proceedings.
EU4PFM Procurement Experts covered key aspects of the European integration process and practical tools for reconstruction:
Oleksandr Shatkovskyi, EU4PFM Senior Legal Expert, explained the rationale behind public procurement regulation in the EU. Under the EU’s Single Market Strategy, a key principle is to ensure a level playing field by removing trade barriers, preventing protectionism in favour of local companies and using public procurement to support other EU policy objectives, including environmental protection and the harmonisation of high standards.
Sergii Yaremenko, EU4PFM National Legal Expert, presented EU and Ukrainian experience in public-private partnerships (PPPs) and concessions. He stressed that PPPs are not only part of the public procurement system but also a strategic investment instrument. According to expert estimates, PPP mechanisms could help cover around USD 292 billion of Ukraine’s reconstruction needs.
The two-day training provided a valuable platform for open dialogue among judges, regulators and experts. These shared insights and practical case studies will support the development of a predictable judicial practice in public procurement.
