The Verkhovna Rada has adopted the new Law on Public Procurement
This is a significant step forward in fulfilling Ukraine’s EU integration commitments.
EU4PFM Procurement experts provided policy advice, inputs and review on this new legislation, which will serve as a cornerstone of Ukraine’s public procurement system aligned with the EU law and best procurement practice.
Key changes include:
- new EU-aligned procurement procedures and tools: innovation partnership, design contests, joint procurement, dynamic purchasing systems
- expanded tender award criteria, introducing a price/quality approach and the possibility of applying non-price criteria
- broader market access, allowing associations of participants to take part in procurement without forming a legal entity, and clearer rules for non-residents
- enhanced transparency and reduced corruption risks through mandatory electronic publication of public contracts.
These changes will also support Ukraine’s recovery needs during the full-scale war.
